بسم الله الرحمن الرحيم

الحمدُ لله ربِّ العالمين والصلاةُ والسلامُ على أشرفِ المرسلين سيدِنا ونبينا محمد المبعوثِ رحمةً للعالمين، صلى الله عليه وعلى آله وصحبه وسلم أجمعين، وبعد..

فلا يخفى على ذوي الألباب أن حالة الجمود والركود والانسداد السياسي الذي عانته مصر طوال العقود الماضية قد أدى إلى التخلف العلمي والتقني والحضاري والأزمات الاقتصادية الحادة،فضلاً عن تهميش الدور المصري على المستوى القومي،وانصراف الشعب عن المشاركة السياسية،فضلاً عن حالة العصيان المدني الصامت التي يعيشها،وللأسف شاركت بعض النُّخب السياسية والفكرية في تعميق هذا الشعور السلبي؛ بخضوعها لإغراءاتٍ وتهديداتٍ متواليةٍ من قِبل الحكومة،وعجزها عن التضحية في سبيل حرية المصريين.

واليوم تمر مصر بظروفٍ تتعرض فيها لضغوطٍ خارجية تستهدف توظيف مقدراتها السياسية والاقتصادية لخدمة المشروع الصهيوني،ولتحقيق المصالح الأمريكية،دون أي تقديرٍ لمشاعر الشعب المصري وطموحاته الحقيقية في الحرية والديمقراطية والرفاهية والعدالة.

وغنيٌّ عن البيان أن مبادرة الإصلاح التي أعلنها الإخوان في 3/3/ 2004 م والتي لقيت ترحيبًا من معظم شرائح المجتمع،لم تلق- سواء هي أو بعض المبادرات الوطنية الهادفة للإصلاح- أية استجابة من النظام الحاكم طيلة ما يقرب من العام!.

حتى تقدم السيد رئيس الجمهورية في أواخر فبراير من هذا العام بطلب تعديل المادة 76 من الدستور المصري بحيث تسمح بانتخاب رئيس الجمهورية من بين أكثر من مرشحٍ بالانتخاب الحر المباشر، وقد رحب الإخوان بهذه الخطوة فور إعلانها،واعتبروها خطوة تمثل تحركًا إيجابيًا على طريق الإصلاح السياسي المنشود،واستجابةً لنبض الشارع المصري،إلا أنه يجب أن تتبعها خطوات أخرى تصب جميعها في خانة إطلاق الحريات العامة،للنهوض بمصر وتقدمها ورقيها،ولمواجهة التحديات الخارجية.

إلا أن الإخوان المسلمين،بعد رصدهم لما تلا إعلان السيد الرئيس من إجراءاتٍ وتصريحاتٍ من قِبل بعض قيادات الحزب الحاكم،يعبِّرون عن قلقهم العميق من المحاولات التي تجري لتفريغ ذلك التعديل من مضمونه، والالتفاف حول الإصلاح الحقيقي الذي يتمناه المصريون ليحفزهم للمشاركة،والعمل الجاد للقيام بواجبهم،ومسئوليتهم الوطنية في النهوض ببلدهم،وتقويته لكي يواجه ما يحيط به من تهديدات.

ولذلك فإن الإخوان المسلمين يؤكدون على مطالبهم المستمرة بالإصلاح السياسي الشامل،ويرون أن الحدَّ الأدنى من الإجراءات التي يجب اتخاذها في هذه المرحلة الدقيقة من حياة الأمة يتمثل فيما يلي:

  1. إيقاف العمل بقانون الطوارئ إيقافًا نهائيًا وفوريًا،وتهيئة المناخ الحر السليم للممارسة الديمقراطية الحقيقية،مثل حرية الاجتماعات الجماهيرية العامة والتظاهر السلمي،والإفراج عن جميع السجناء والمعتقلين السياسيين،ووقف الإجراءات التعسفية،وكافة أشكال التعذيب البدني والنفسي الذي يُمارس من بعض أجهزة الأمن في حق المواطنين،وذلك كمقدمة لعمل مصالحة عامة بين أبناء الأمة بما يعمِّق الانتماء بين أبناء الوطن جميعًا.
  1. إلغاء المحاكم والقوانين الاستثنائية المقيدة للحريات،وعلى الأخص قانون الأحزاب،وقانون المدعى الاشتراكي وقانون مباشرة الحقوق السياسية وقانون النقابات وغيرها من القوانين التي أدَّت إلى حالة الجمود والانسداد السياسي الذي تعانيه الحياة السياسية المصرية،مع إطلاق حرية إصدار الصحف وتشكيل الأحزاب السياسية دون أية قيود،وأن يكون الناخب هو المرجعية الوحيدة في تقرير شعبية ومكانة أي من هذه الأحزاب في الحياة العامة في مصر.
  1. تهيئة المناخ المناسب والسليم لإجراء انتخابات حرة تعبر تعبيرًا حقيقيًا عن الإرادة الشعبية في اختيار قيادتها وممثليها في مجلسي الشعب والشورى والمجالس الشعبية المحلية،ويجب أن تتم تنقية جداول الانتخاب،والإسراع بالانتهاء من مشروع الرقم القومي لضبط عملية التصويت،وتوفير الإشراف القضائي الكامل على العملية الانتخابية برمَّتها وفي جميع مراحلها،والتوقف عن أية تدخلات خارجية تؤثر على نزاهة العملية الانتخابية وحرية الناخبين في ممارسة حقهم،بل واجبهم الانتخابي.
  1. تفعيل دور مؤسسات المجتمع المدني وإزالة المعوقات أمام إنشائها،وعدم التدخل في شئونها من قِبل الأجهزة الأمنية.
  1. لن يكتمل الهدف من تعديل المادة 76 من الدستور إلا بتعديل مواد أخرى تتعلق بالصلاحيات غير المحدودة التي يتيحها الدستور لرئيس الجمهورية، وكذلك بعدد مرات ولاية الرئيس ومدة الولاية الواحدة،حيث ينبغي ألا تتجاوز فترة الرئاسة أربع سنوات قابلة للتمديد لمدة واحدة فقط،وفي هذا الصدد ندعو إلى تشكيل لجنةٍ عليا من 25 فقيهًا دستوريًا من كافة الاتجاهات لتقوم خلال شهر واحد بإعداد التعديلات المطلوبة لإقرارها وِفق الطرق الدستورية.
  1. فيما يتعلق بانتخاب رئيس الجمهورية،يجب إتاحة فرصة الترشيح لكل من يرغب ويرى في نفسه القدرة على الاضطلاع بمهام هذا المنصب الرفيع،سواء كان حزبيا أو مستقلاً،على أن يُكتفى بالحصول على عددٍ من توقيعات الناخبين لا يتجاوز عشرين ألفًا موزعين على مناطق مختلفة من الجمهورية،ويجب ألا توضع أية عراقيل أو شروط تعجيزية تفرغ التعديل المقترح من مضمونه،وتمنع المواطنين من التقدم للترشيح،أو تقلل من فرص توافر منافسة حقيقية بين أكثر من مرشح يختار الشعب من بينهم من يرى أنه الأصلح أوالأقدر على قيادتهم.

ويؤكد الإخوان أنهم بهذه المطالب لا يبتغون غير وجه الله وإصلاح الوطن، ولا يهدفون إلى أية مكاسب سياسية أو مغانم عاجلة،وأنهم سوف يؤيدون أي مرشح يرون فيه الكفاءة والقدرة لقيادة مصر في هذه المرحلة الحرجة من تاريخها،وأنهم سيسعون- باستخدام كافة الوسائل الدستورية والقانونية والسياسية- إلى تحقيق مطالبهم ومطالب الأمة في حياة ديمقراطية سليمة تتوافر من خلال الحريات والمناخ اللازم للممارسة السياسية الصحيحة،دون أي تدخل أو فرض من الخارج،لتحقيق مصلحة الوطن ورفعته ووصوله إلى المكانة التي يستحقها بين أمم العالم.

وفي هذا الصدد ندعو الشعب المصري بكل مكوناته وكافة اتجاهاته وفئاته وقواه وأحزابه ومفكريه ورجاله ونسائه،وخاصةً ذوى الرأي في كافة مؤسسات الدولة،أن يسهموا في التفاعل من أجل إنجاز هذا التغيير الدستوري المرتقب،وأن يشارك جميع المعنيين في كل الفاعليات،وأن يستخدموا حقهم الدستوري في التعبير عن رأيهم لدى المؤسسات التشريعية ومؤسسة الحكم حتى تستجيب لنداء الأمة ورغبتها في حياة أفضل.

إننا جميعًا مطالبون بالوقوف بكل حزم أمام بعض المحاولات التي تتم الآن من أصحاب المصالح الفردية لتفريغ هذا التعديل المرتقب من مضمونه،ونحن في ذلك نؤكد على ضرورة الالتزام بالدستور والقانون في التعبير عن الرأي بكل الوسائل المشروعة،وبالطرق السلمية الموضوعية،لضمان الحفاظ على وطننا العزيز وعلى شعبنا وقومنا،وضمان حفظ الاستقرار،وعدم السماح لأحد بالخروج عن الإطار المنضبط في الأداء السلمي للتعبير عن الرأي.

وفي النهاية ندعو الحكومة ورموزها إلى الكفِّ عن الأسلوب اللامنطقي واللامعقول الذي تتعامل به مع قضية الإصلاح الدستوري والسياسي،وأن ترتفع إلى مستوى طموحات الشعب وأمانيه،فالتحديات الداخلية والخارجية التي تواجهها مصر في هذه المرحلة تقتضي تكاتف كافة الجهود وتضافر كل القوى،فضلاً عن الجدية واستشعار المسئولية،والإحساس بالأمانة من أجل نهضة الأمة وتقدمها.

حفظ الله مصر شعبًا ووطنًا،ووقاها من كل سوء "فَسَتَذْكُرُونَ مَا أَقُولُ لَكُمْ وأُفَوِّضُ أَمْرِي إلَى اللَّهِ إنَّ اللَّهَ بَصِيرٌ بِالْعِبَاد" (غافر: 44)، "واللَّهُ غَالِبٌ عَلَى أَمْرِهِ ولَكِنَّ أَكْثَرَ النَّاسِ لا يَعْلَمُونَ" (يوسف: 21).

والله من وراء القصد وهو يهدي إلى سواء السبيل... والسلام عليكم ورحمة الله وبركاته.

In the Name of Allah; The Most Gracious, The Most Merciful

A Statement from the Muslim Brotherhood on the Constitutional and Political Reform

Praise be to Allah, The Lord of the Worlds and prayers and peace be upon the most noble of His messengers, our master and prophet, Mohammed, who was sent as a mercy for all mankind, and upon all his descendants and Companions.


No one can be in doubt as to the political stagnation, recession and blockage which Egypt has suffered throughout the past number of decades, nor can anyone doubt that this situation has lead to scientific, technological and civilizational regression as well as to an acute economic crisis and the marginalization of the Egyptian role on the national level. This situation also led to widespread political apathy and to a state of silent civil disobedience throughout the Egyptian nation.


It is regrettable that a number of the political and intellectual elite participated in reinforcing this negative attitude by submitting to continuous government threats and seductions and by failing to make any sacrifices for the sake of the Egyptian people"s freedom.


And today, we find Egypt enduring external pressures which aim to exploit its political and economic resources for the benefit and service of the Zionist project and American interests, without any consideration for the Egyptian people and its real aspirations for freedom, democracy, welfare and justice.


It goes without saying that the initiative for reform which the Brotherhood proposed on the 3rd of March 2004, and which was met with widespread welcome from all sectors of Egyptian society along with other similar national initiatives for reform, failed to bring any response from the ruling authorities over more than a year, until the President requested the amendment of Article 76 of the Egyptian Constitution in late February, so that the President is elected from among a number of candidates by a free and direct elections. The Brotherhood welcomed this step as soon as it was announced and considered it to be a positive step on the path to the desired political reform and a positive response to the climate prevalent throughout Egyptian society. However, we believe that this must be followed with a number of other steps which all serve the cause of allowing public freedoms so that Egypt rises as a nation and becomes capable of facing all foreign challenges.


Yet the Muslim Brotherhood, having monitored the procedures and statements made by leaders of the ruling party following the President"s announcement, express their grave concern regarding attempts to rid the President"s declaration from its profound essence and to by-pass real and true reform that Egyptians wish for so that they may participate and work seriously in order to perform their national duties that would lead to their country rising to meet all the challenges that she faces.


Therefore, the Muslim Brotherhood affirm their continued demand for comprehensive political reform and believe that the very least of procedures that ought to be made in this delicate phase of our nation are as follows:


1) To stop, immediately and completely, the implementation of Emergency Laws hence allowing a free and proper climate for true democratic practice, such as the freedom to congregate and organize public meetings as well as the right to peaceful demonstrations. Also, to immediately release all political prisoners and to cease all oppressive procedures and all forms of physical and mental torture which some security bodies exercise against Egyptian citizens, all this as a preliminary step towards a national reconciliation with the Egyptian people and towards ensuring a more profound sense of national belonging.


2) To cancel all exceptional legislations and courts of law which restrict freedoms, particularly the Political Parties Act, the Socialist Attorney Act, the Practice of Political Rights Act, Trade Unions Act and others that led to a state of political stagnation and blockage witnessed throughout Egyptian society. The freedom of publications and unrestricted formation of political parties must be implemented as well as an appreciation that the voter is the sole authority in determining the popularity and stature of any of these parties within Egyptian public life.


3) To Afford an appropriate and healthy climate for carrying out free elections that truly reflect the people"s will in selecting its leadership and representatives in Congress, Parliament and local councils.


lectoral lists must be examined and all facts that allow a free and fair elections must be ascertained as soon as possible, with full judicial supervision over the electoral process in all its phases and levels. All external influences upon the electoral process or upon the freedom of voters to exercise their rights, indeed their civil duties, must cease.


4) The role of organizations of civil society must be activated, with all obstacles to their formation removed. Security forces must not intervene in the work and operations and affairs of these organizations.


5) The objective of amending Article 76 of the Constitution will never be fulfilled unless other amendments pertaining to infinite authorities offered by the Constitution to the President, and the number of terms permissible and the length of each term, are also made. It is our stand that each term must not exceed four years and that the President may be re-elected no more than once. Within this context, we call for the formation of a supreme committee of 25 Constitutional Jurists from all tendencies to prepare all proposals of constitutional amendments for final approval, within one month.



6) In relation to the President, all who sees in himself the ability and suitability to hold this high office must have the opportunity to become a candidate, whether or not he is a member of a political party, on condition that he attains the signed endorsements of no more than 20,000 voters from across Egypt. It is vital that no insurmountable restrictions be placed which would rid the proposed amendment of its essence and prevent citizens from stepping forward to nominate themselves, or indeed reduce the chance of serious competition from those standing as candidates, so that the people may choose whoever they sees fit and capable of leading them.


The Muslim Brotherhood confirms that these demands are made in all sincerity and in pursuit of the pleasure of Allah and the true reformation of our homeland, rather than in pursuit of any political gains or speedy benefits. The Brotherhood also confirms that it would support any candidate whom it sees enjoys the ability and efficiency to lead Egypt in this difficult time of its history. It will also seek to fulfill its demands and those of the entire nation in a proper democratic life through all constitutional, legal and political means, so that freedoms are enhanced and a climate appropriate for proper political practice prevails, without any foreign interference or enforcement, so that our homeland may achieve the highest status among the countries of the world.


Within this context, we call upon all the Egyptian people, of all sectors, tendencies, formations and forces, all its parties, intellectuals, men and women and all those who work within governmental authorities, to contribute positively towards fulfilling this awaited constitutional amendment, and for all those concerned to participate in all functions and activities and utilize their constitutional rights to express their views before constitutional bodies and the Government, so that it ultimately responds to the nation"s aspiration for a better life.


We are all requested to stand firm in the face of attempts by some to further individual and personal benefits so that this proposed amendment is rid of its essence. In this context, we affirm that all elements must abide by the Constitution and by the law in expressing their views through all available peaceful and objective means and methods so that the security and stability of our beloved homeland and nation remain intact.


Finally, we call upon the Government and its prominent figures to cease its unreasonable methodology with which it deals with the issue of political and constitutional reform and that it rises to the level of aspirations held by the people, as the internal and external challenges which Egypt faces today demands the solidarity of all its elements and tendencies as well as a strong sense of responsibility and trust for the sake of the nation and its prosperity.

May Allah protect Egypt and its people and May He preserve it from all evil and mischief.
